Oceana's Ocean Heroes Contest: Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO NOMINATE OR WIN.

HOW TO NOMINATE:

No purchase necessary to nominate or win. To nominate someone for the Ocean Heroes Contest (the “Contest) visit www.oceana.org/heroes and complete and submit all required “Nominator” (individual submitting a nomination) and “Nominee” (individual being nominated) fields on nomination form. By submitting a nomination, the Nominator affirmatively indicates acknowledgment and acceptance of these Official Rules and all other terms and conditions governing the Contest. Oceana will begin accepting nominations on March 30, 2011 and the nominating period will end at 11:59 pm (ET) on April 27, 2011.

ELIGIBILITY:

Nominee: Any individual who has volunteered, organized, cleaned up or otherwise acted in a way that benefits the world’s oceans, its inhabitants or the communities and peoples that depend on ocean resources may be nominated.

Nominator: Nominators may nominate themselves or other people, but Nominators must be at least 13 years of age or older. Nominations by individuals under 13 years of age will not be accepted. There is no limit on the number of nominations an individual may submit, but Nominators may only nominate one person at a time and may not nominate the same person more than once. All submitted nominations become the property of Sponsor and will not be acknowledged or returned

Contest void wherever prohibited by law, or where the registration or filing requirements of any state or local jurisdiction have not been complied with. Employees of Oceana Inc. (the “Sponsor”), its respective affiliates, subsidiaries, advertising, production and promotion agencies, and the immediate families and members of the same household of each are not eligible to be nominated. All federal, state, local and municipal laws and regulations apply.

NOMINATION REQUIREMENTS: Nominations will be received from March 30, 2011 until 11:59 pm (ET) on April 27, 2011 and must include all required information about Nominator and Nominee, as indicated on nomination form. Nominations may be made via www.oceana.org/heroes or by mailing a nomination form to Oceana at: Oceana, Attn: Ocean Heroes Contest, 1350 Connecticut Avenue NW, 5th Floor, Washington DC 20036. Mailed nominations must arrive at Oceana’s office no later than April 27, 2011.

FINALIST SELECTION:

Sponsor’s marketing staff will review and approve all eligible nominations. Nominations including false or inaccurate information are subject to disqualification. Once initial reviews and approvals are completed, a finalist Selection Panel (“Panel”) composed of Oceana marketing, development, policy, and science staff will choose three to nine finalists for both a “Junior” category (nominee under 18 years of age) and an “Adult” category (nominee 18 years of age or older). The number of nominations a Nominee receives will not dictate whether or not the Nominee is chosen as a finalist. Finalists are chosen at the sole discretion of the Panel.

Finalists will be contacted by phone, email, and/or express mail on or about May 2, 2011. Finalists will be asked to provide a photograph, verify the information provided in their nomination and consent to having their likeness and story promoted on www.oceana.org/heroes. Nominees that do not consent to having their likeness and story promoted on www.oceana.org/heroes are not eligible to participate. The finalist’s photograph (a) must be the original and sole creation of, and all right, title and interest including but not limited to the copyright in the picture must be owned solely by, the finalist; (b) may not infringe upon any third party’s rights, including but not limited to copyright, patent or trademarks/tradenames/logos, or rights of privacy or publicity, or contain material that is or may be considered defamatory, slanderous or libelous, or portray in a false light; © may not violate any law, rule or regulation; and each entrant warrants and represents that her picture complies with all of those conditions. Non-complying pictures will be subject to disqualification as are nominations that are discovered to contain false, misleading or inaccurate information.

VOTING: Voting on Contest finalists will begin on May 9, 2011. Voting is open to all individuals 13 years of age or older and individuals may vote one time for a finalist in the Junior category and a finalist in the Adult category. To submit a vote, individuals must go to www.oceana.org/heroes, and submit all required information before clicking “Vote”. Votes will only be recorded if all required information is submitted via www.oceana.org/heroes. The voting period will end at 11:59 pm (ET) on May 31, 2011. The finalists with the most votes in their respective category will be selected as the winner in that category. Should the Sponsor discover a voter who is not complying with the Official Rules, the Sponsor reserves the right to not count any votes made by the noncompliant voter.

PRIZES:

Contest winners will receive:

    * $500 gift card from Nautica

    * Revo Sunglasses

Contest finalists (excluding winners) will receive:

    * $100 gift card from Nautica

Oceana may include additional prizes for Finalists and Winners if they become available.

AFFIVADAVIT OF ELIGIBILITY AND PUBLICITY RELEASE:

Where permitted by law, winners grant Oceana (which grant will be confirmed in writing on request), their subsidiaries, affiliates and those acting pursuant to their authority, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winners’ names, portraits, pictures, voices, likenesses, city and state of residence and biographical information for advertising and promotional purposes without additional consideration. Except where prohibited by law, winners will be required to sign an Affidavit of Eligibility and Release or forfeit the prize. Failure to comply, or return any required releases and related documentation, may result in forfeiture of the prize.

TAXES AND EXPENSES:

All applicable local, state, airport, departure and federal taxes, if any, will be paid by the winners and finalists. These may include income and/or sales taxes based on the retail value of the prizes or transportation or travel taxes. Any and all expenses not specifically listed as covered in these Official Rules are the sole responsibility of and will be paid by the winners.

FINANCIAL INFORMATION:

Winners agree to provide such financial information to Oceana as is necessary for Oceana to complete all necessary tax forms in order to comply with federal, state and local tax requirements. Failure to provide this information will result in forfeiture of the prize.

WINNERS LIST AND OFFICIAL RULES:

The winners’ names and Official Rules shall be posted at www.oceana.org/heroes. A list of winners and/or the Official Rules may also be acquired by sending a request for the list or rules to Oceana at: Oceana, Attn: Ocean Heroes Contest, 1350 Connecticut Avenue NW, 5th Floor, Washington DC 20036.

RELEASE AND LIMITATIONS OF LIABILITY:

By participating in this Contest, entrants agree that Oceana and its affiliates, subsidiaries and agents, and its employees, officers, directors, representatives and agents, advertising or promotion agencies and legal counsel (the “Releasees”) will have no liability whatsoever for, and shall be held harmless by Entrants (including Nominators, Nominees and Voters) against, any liability for any injuries, losses or damages, claims and actions of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prizes, entry or participation in this Contest or in any Contest related activity, or any claims based on publicity rights, defamation or invasion of privacy or merchandise delivery. Releasees are not responsible for and shall not be liable for: (1) lost or late, damaged, misdirected, incomplete, unintelligible, entries; (2) problems caused by telephonic, electronic, hardware, software programs, networks, the internet, viruses, works, Trojan horses or computer malfunctions (failures, errors or difficulties of any manner); (3) failed, incomplete or delayed computer transmission; (4) any condition caused by events beyond control of Releasees that may cause the Contest to be disrupted or corrupted. Releasees are not responsible if any prize cannot be awarded due to travel cancellations, delay or interruptions due to acts of god, acts of war, natural disasters, weather or terrorism. Except where legally prohibited, by acceptance of prize, winners grant (and agree to confirm that grant in writing) permission for Releasees to use their respective names, portraits, pictures, voices and likenesses, for advertising or publicity without additional compensation. The Contest is governed by the laws of the United States. All federal, state and local laws and regulations apply. This Contest is void where prohibited by law.
